
A question we get at Hernandez & Associates often is can I get a TABC permit for a (insert structure here). Our goal is to guide clients that are applying for a TABC permit in the state of Texas.
We have heard dozens of different type of structures that business owners have tried to get TABC permits for. In this post we will do our best to outline what you need to answer in order to determine if a structure is eligible for a TABC permit.
Certificate Of Occupancy
First, Will this structure be able to get a Certificate of Occupancy (CO)?
Most of the time your local City government will be the ones to issue the CO. Each city will have their own regulations of what is needed for the structure to get approved.
It is likely that you may not be able to get a CO for a food truck or residential location depending on your local ordinances. If you are able to get this then you can move to the next item.

Landlord
Next, Will the owner or landlord of the location allow you to get a TABC permit to sell alcohol? We like to mention this because we have seen a few times in the past that clients assumed the landlord would be okay with them selling alcohol on the premises. Then find out after they have invested money into the business the landlord would not allow this.
If you own the property free and clear then of course this won’t be an issue. Note if you will be using a property which you reside TABC will treat the entire premises like a business. This will allow them to enter and inspect the entire property at their discretion.
Health Department
Then, After you pass the 2 checks above you will need the Health department’s approval of this location. Each local government agency have their own regulations so be sure to keep this in mind.

City and Counties
Furthermore, We suggest that you check with local city or county rules to find if they allow businesses to sell alcohol. We have seen this affect a few businesses throughout Texas. Not all areas have these rules so please be aware you may need to make necessary adjustments.
TABC
Lastly, if you have been approved by all of the above we suggest you make sure that TABC and/or TTB will allow you to get the proposed structure permitted. For the most part both TABC and TTB have similar guidelines. In most cases if you get one approved its likely but not guaranteed you will get the other approved.
